The landlord and tenant arrangement can be complicated sometimes. It may seem cut and dry when you sign the lease, but then there will be some situations that will show up that can make this more difficult and you worry about who is in the right. One example is whether the landlord has to give you notice before they come to your apartment or not. Can they just walk right in when they want, or do they need to give you that notice?

 

The problem comes with who owns the property. Yes, the landlord owns the building and is the one responsible for it and profiting off it. But you are renting that unit, paying them for the space and using it as your home. You do not want someone to just walk in when you try to relax, invading your privacy and your space. That is why there are usually some rules when it comes to whether the landlord is allowed to come in.

 

In most jurisdictions, the landlord does have to give 24 to 48 hours notice before they come into the apartment to check on something or to do some repairs. The tenant does have to allow the landlord to come in and look around, as long as they are given a notice, or they can reschedule it with the landlord to get the work done. These can include routine inspections or even to repair something that was broken.

 

There is an exception to this one though. If there is some kind of emergency, then the landlord is allowed to come into the apartment to fix the problem. For example, if you have a pipe burst and you are not home, then the landlord can get in there to turn off the water and try to fix the problem. This will prevent your apartment from suffering from more damage and can protect the units that someone else is living in, which is why the landlord can have that exception.
